Terms of Service

The agreement for using Tally Poker, the free tracker for home poker cash games.

Effective

Also read our Privacy Policy.

These terms are an agreement between you and [Operator name] (“we”, “us”) about your use of Tally Poker, the website, the web app and the mobile apps (together, “Tally Poker”). By using Tally Poker you accept these terms. If you don’t accept them, don’t use it.

What Tally Poker is, and isn’t

Tally Poker is a record-keeping tool for private home poker cash games. It records buy-ins, rebuys, add-ons, transfers and cash-outs, works out each player’s result, and suggests the fewest payments to settle up.

  • It is not a gambling service. There is no betting, wagering or game of chance in Tally Poker.
  • It does not hold, move or transfer money, and it does not process payments. Players settle with each other outside Tally Poker.
  • A suggested payment, a settlement summary or a Splitwise entry records a debt. None of them is proof that anyone has paid.
  • Nothing in Tally Poker is financial, legal or tax advice.

Who can use it

You must be at least 18 years old, or the age of majority where you live if that is higher, and able to agree to these terms. You are responsible for making sure that the games you record are lawful where you play them. Rules for private poker games differ between countries, states and cities.

Your account

You sign in with a Google account. Keep that account secure: anything done while signed in as you is treated as done by you. Tell us promptly if you think someone else has used your account.

You can delete your account from Settings at any time. What happens to your data when you do is described in the Privacy Policy.

Hosting, joining and approving

  • Any signed-in user can create a game and act as its host. Hosts can invite players, add guests, record entries, enter final cash-outs and close the game.
  • An entry the host records for a registered player stays pending until that player, another involved player, or the host approves or rejects it. The first decision counts and is recorded with who made it.
  • Approving an entry means you confirm it is correct. Check amounts before you approve them.
  • Hosts are responsible for the accuracy of the cash-outs they enter and for how they handle a count that doesn’t match.
  • Closed games become a fixed record. Corrections are made as new records, not by rewriting history.

Guests

Hosts can add guests who don’t have an account. A host who enters a guest’s name and amounts must have the guest’s permission to do so, and is responsible for that information being accurate.

Splitwise

Hosts can choose to send a finished, balanced settlement to a Splitwise group. This is an optional, unofficial integration: Tally Poker isn’t made by or affiliated with Splitwise, and the integration may stop working if Splitwise changes its service. Your use of Splitwise is governed by Splitwise’s own terms. You can always copy the settlement summary instead.

Using Tally Poker fairly

Don’t use Tally Poker to:

  • break any law, or run or promote illegal gambling;
  • record information about people without their permission, or harass anyone;
  • try to get at data, games or accounts that aren’t yours, or get around the app’s security and access rules;
  • disrupt, overload or reverse-engineer the service, or scrape it with automated tools;
  • pretend to be someone else.

We may suspend or close accounts that do any of these things.

Your information

You keep ownership of the information you put into Tally Poker. You give us permission to store, copy and display it as needed to run the service, including showing a game’s records to the other players in that game. This permission ends when the information is deleted, except for records that other players’ games still depend on, as the Privacy Policy explains.

Free, with ads

Tally Poker is free to use and is supported by a small number of ads. The settle-up calculator and other free tools on the website are provided as they are, for your convenience. Check their results before relying on them.

Changes and availability

We may change, add or remove features, and we may stop offering Tally Poker. We aim to keep it running, but it may be unavailable at times. Changes on our side will never alter the amounts recorded in a closed game.

Disclaimers

Tally Poker is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted, error-free or fit for a particular purpose, and we are not responsible for disputes between players, for debts recorded in Tally Poker, or for payments made or not made.

Limits on our liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost money, data or profits, arising from your use of Tally Poker. Where liability can’t be excluded, our total liability is limited to the greater of the amount you paid us in the past twelve months, which for a free service is nothing, and 50 US dollars. Nothing in these terms limits liability that can’t be limited by law, or any rights you have as a consumer.

Your responsibility to us

If someone makes a claim against us because of how you used Tally Poker, for example by recording a guest’s information without permission, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.

Governing law

These terms are governed by the laws of [governing law jurisdiction]. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.

Changes to these terms

We may update these terms. If a change is significant, we will tell you in the app before it takes effect. Continuing to use Tally Poker after a change means you accept the new terms.
